Synopsis for 2007 Zoning Change
Present wording:
A. ~The Building Inspector shall not issue a Building Permit unless the provisions of the Zoning Ordinance, as most recently amended, Building Code as most recently amended, and the International Code Council’s Building, Fire, Plumbing, Energy, Residential Codes, as most recently amended and as established by the International Code Council and Code Administrators International, Inc. have been complied with. Proposed wording change:
A. ~The Building Inspector shall not issue a Building Permit unless the provisions of the Zoning Ordinance, as most recently amended, and the State of New Hampshire Building Code and State of New Hampshire Fire Code, as most recently adopted and amended, have been complied with.
Reason for change:
In the last several years, the New Hampshire Legislative Sessions have been attempting to bring the New Hampshire Building Code in line with the International Codes.~ By accomplishing this alignment, the building standards adopted in New Hampshire would reflect commonly accepted practices and these standards would be consistent throughout the State.~ In addition, the State has actively pursued a statute that could be consistently referenced by Town/City zoning ordinances without constant change to applicable zoning ordinance sections.~ The State feels it has achieved these goals with the latest version of RSA Chapter 155-A, New Hampshire Building Code, and has requested applicable Town/City zoning ordinances reflect RSA 155-A, as a minimum standard.
The subsequent changes if approved by ballot vote on Election Day:
1.~ The Town of Nottingham Building Code, section II. ~PERMIT NOT TO ISSUE, INJUNCTION: PENALTIES will be changed to reflect the proposed words above.
2. ~State law stipulates that any State regulation that is more stringent than local regulations would make the local ones null and void.~ Therefore, the following sections of the Town of Nottingham Building Code will be deleted since the New Hampshire State Building Code/Fire Code is either equal to or more stringent than the Town’s present requirements:
