Notice of Determination

To All Planning Board Applicants:
At their June 13, 2007 Workshop Meeting, the Planning Board unanimously determined that they will enforce the current Subdivision Rules and Regulations, as written:
Subdivison Rules and Regulations – Section IV F:
No structure, wells, or septic facilities shall be constructed or permitted within any setbacks including but not limited to boundary lines, wetlands, watercourses, and drainage ways.
However, a majority of the Nottingham Planning Board determined that a septic system is not considered a structure based upon the current Town of Nottingham Building Code and Zoning Ordinance Regulations:
Zoning Ordinance Section XV – Definitions:
STRUCTURE – Anything constructed or erected, except a boundary wall or fence, the use of which requires location on the ground or attachment to something on the ground.
